. but there is some things that are absolutely stunning, that this happened on 9/11, and the fbi at some point was sent in to investigate. and then on october 26, 6 weeks later, foreign policy magazine went to the consulate, went to the cia annex. they found a draft of two letters. and letters that they have no idea thisf they were ever, ever sent anywhere. but a draft of two letters that the fbi never picked up when they were there. and two draft, talk about this fact that that day, they saw some member of the bolivian police force across the street in the upstairs, taking pictures inside the compound and they were worried and concerned. why that evidence was not seized by the fbi, i don't know. another thing that happened, david ignatius of the washington post, met with the cia. the cia gave them a timeline as to what happened. this is what is new for me. number 1, it appears that the last two who were killed were not killed until about 5:00 hirt in the morning, which fwaifs another hour for the -- which gives another hour for the united states to take military action. but secondly, let me r

officials suggest a team deployment of certain allowed the fbi access to the site in benghazi much sooner than the 24 days that would eventually take the fbi to get on scene for security reasons. fox has been granted access to internal e-mails to document the frustrations of senior officials within the counterterrorism community, but also e-mails that suggest there were warnings from the conflict itself on septemb september 11 that they believed members of the libyan police force had photographed the consulate earlier in the day and possibly the libyan police were involved in some sort of surveillance of the conflict. and as we have previously reported, sean smith mentioned in his online post that night they were very concerned he and chris stevens and others that policeman may have been photographing the conflict for nefarious reasons. they have made aware the e-mails, they continue to lament days after that an unwillingness to the administration to knowledge the attack was terrorism. according to one agent i spoke with, the response process was isolated at the most senior level of the o

of terror. we had the fbi and i believe the national center for counterterrorism also giving briefings. >> paul: that's right. >> saying this. why was general petraeus's testimony then so at odds with other parts of the community? >> but does this, would this give-- what does it mean for, say, susan rice and the administration then? is this, does this help them politically by shielding them or does petraeus here saying i thought it was a terrorist attack, does that mean this puts, for example, susan rice's statements more up to scrutiny? >> well, i think answers the fundamental question, did they deliberately mislead on this case for political reasons because they were driving the narrative that al-qaeda had been decimated and the war, war was receding or a question of incompetence. neither of those two things is good for the administration although it's after the election, so, they can get the consequences. >> let's take a look at the president talking about susan rice, the u.n. ambassador who many think he will nominate to succeed hillary clinton as secretary of state. >> for them to

that killed four americans the fbi is getting access to the seoul suspect in custody. he is currently being held in tunisia. he was arrested in the days after the attack but it wasn't until company and the next guest put pressure on the authorities in tunisia. it didn't go to the crime scene the murder scene for a week. >> joining us right now is the senator. >> senator you got access. there is even some conditions on the access isn't there? >> the important thing is we do have access to the individual. there are individuals they are placed on interrogations by the host country. the thing is we face to face access for this guy. this started not long after i left you last week in new york. i went after the fbi in charge of this investigation. these very professional men and women who do a good job every single day investigating crimes were really frustrated. i could tell that because they were being asked to operate with one hand behind their back. we knew this guy was in custody yet nobody was doing anything to get the face to face interrogation with them. so it was a matter of senator grah

been no formal response. and within the last few minutes, greta van susteren has reported that the fbi is now on the ground in tunisia to question the only known suspect in custody and significantly this comes after the intervention of republican senator lindsey graham who wrote tot tunisian government requesting questioning why there was a lack of access to the suspect. jenna: senator graham spoke to jon yesterday and mentioned his frustration with that. interesting to watch that side of the story. >> reporter: one point on that. this really begs the question if a senator could intervene with the tunisian government six weeks after the attack and at least a week after the suspect was in custody, why was it that apparently the white house or the justice department didn't take the same course of action? jenna: sounds like a good question. jon will be discussing this a little bit now. great reporting as always, catherine. thank you. >> reporter: you're welcome. jon: these brand new revelations could bring more political fallout just four-days before the election. let's bring in jonah gol
